In the case of sham trials that provide cover for the perpetrators of serious crimes under international law or pardons granted for the persons who have been convicted of such crimes, the rule of exception to ne bis in idem has been developed in international criminal justice. Whereas this rule is intended to promote the ‘combating impunity’campaign, as the ne is in idem principle protects the accused persons from abusive dual trials, exceptions to such principle require legal justification. This article reviews the introduction and development of the rule of exception and examines if the extended rule of exception to ne bis in idem can be justified. The rule of exception was proposed at the drafting of the statute of International Criminal Tribunal for the former Yugoslavia as a rule to ensure complete trial. However, the Ieng Sary case at the Extraordinary Chamber in the Courts of Cambodia extended the exception to complete punishment. This article argues that this new rule of exception lacks legal grounds and cannot be accepted from the perspective of human rights of the accused.
