Abstract
本研究ノートは、平成28年度大阪大学博士課程教育リーディングプログラム「超域イノベーション博士課程プログラム」独創的な教育研究活動経費に採択された研究テーマ「労働の外部化と人権―アカデミズムの役割とは―」に基づき実施した研究活動成果の一部をまとめたものである。本研究活動においては、労働者の生計の確保等、人道的配慮と効果を両立した取引規制の在り方を検討することを目的とし、アフリカ大湖地域における紛争鉱物規制を事例として、文献調査と関係者へのインタビューを行った。世界的な紛争鉱物規制のダイナミクスが特にコンゴ民主共和国とルワンダ共和国にもたらした影響について、その一連の流れを追った。また一連の紛争鉱物規制の取り組みの中で、両国に最も大きなインパクトを与えた米国のDodd-Frank 法を取り上げ、規制をデザインする上でのローカルなコンテクストに配慮する重要性を明らかにした。
This research note is a result of a project “Outsourcing of Labour and Human Rights –a Role of Academia–” which was funded by 2016 Grant-in-Aid for Education and Research from the Cross-Boundary Innovation Program of Osaka University. The project aimed to suggest a new trade regulation which balances effectiveness and humanitarian considerations such as protection of labourer’s livelihoods, taking minerals regulation in the African Great Lakes Region as a case. Bibliographic survey and interviews in Rwanda were conducted. The paper focuses on the influence of the dynamics of global conflict minerals regulation on Democratic Republic of Congo and Republic of Rwanda and describes its process. This paper also takes a close look at the US Dodd-Frank Act 2010 that brought the biggest impact on these two countries among a series of conflict minerals regulations, and points out the importance of a local context of these countries in designing regulations.
